Overtime

According to the Employment (Amendment) Act 2022, the employee's normal working hours should not be more than 45 hours per week. Those monthly wages that do not exceed RM4,000.00 are entitled to overtime and are covered by Employment Act regulations.

Any work performed beyond the normal working hours is considered overtime, and the maximum overtime hours is 104 hours.

When will be considered to overtime for employees?

  • Overtime after normal working hours
  • Overtime during non-working days/rest days
  • Overtime during public holidays

Overtime payment is followed on the employee’s ordinary rate of pay (ORP) & overtime rate:

OVERTIME RATE
Normal work day ORP X 1.5
Rest days (Sunday) ORP X 2
Public holiday ORP X 3
